SESIS payment Q&A
When will I receive payment for the time that I worked outside regular work hours on SESIS based on the arbitration decision?
SESIS users received checks during the month of April. Occupational and physical therapists, who are in a different payroll bank, received payment in the April 12 check, and other SESIS users received their back pay in the April 30 check. These checks reflected payment for the time that you performed SESIS work outside your regular workday between September 2011, when SESIS was launched citywide, and Dec. 31, 2012. Consistent with the arbitrator’s award, you will not be paid for SESIS work done during your lunch hour.
How will I be paid?
The payment will be included in your regular paycheck. An explanation will be attached to the payment. As with all income, taxes will be deducted from your payment.
How did the DOE calculate payment?
The data is being provided by the SESIS system itself. All time that you spent logged in to SESIS was listed and compared to your school’s workday and the contractual number of hours in your job title’s workday, including the 37.5 minutes, where applicable. All time spent logged in to SESIS outside your workday, including weekends and holidays, was added up. Payment was calculated at a pro-rata rate based on your annual salary. Time was added to each session to account for login time. You will not be paid for SESIS work performed during per session activities and/or Chapter 683 work.
How do we know that the calculations were done correctly?
The arbitrator ordered the DOE to provide us with the data that it used to calculate payment. We will be able to verify the number of minutes logged in to SESIS and the workday that the DOE used to make the calculations.
I recently retired. Do I get back pay?
SESIS users not on payroll in April because they are on leave or recently retired are eligible for compensation if they spent time logged in to SESIS after work hours between September 2011 and Dec. 31, 2012. We don’t yet have a date when these checks will be issued, but we will fight to make sure that all SESIS users receive the money they are owed.
What should I do if I think my check is wrong or if I believe that I deserve back pay and didn’t get it?
You should contact your borough office either by phone or in person. You will be asked to provide the following information at that time: your EIS or employee ID number; your title; your gross annual salary including differentials; number of years of service; and the official start and end time for each day of the week for each school you worked in from September 2011 to January 2012, February 2012 to June 2012, and September 2012 to December 2012. If you have a copy of your work site’s bell schedule, please bring it with you. If you worked in a multisession school, you will also be asked for your specific work schedule. You will also be asked if you worked a regular per-session activity, such as summer school, during this period. If you are a guidance counselor, social worker or psychologist, you will be asked to provide the number of minutes in your assigned lunch period during the period of September 2011 through December 2012.
What will happen once I provide this information to the UFT?
A UFT representative will review the SESIS login data for you and determine the best way to proceed. We are in discussions with the DOE regarding the process that we will use to address discrepancies.
How should I proceed with my
The DOE directive that you should not work on SESIS during your lunch period or outside your workday is still in effect. If, based on what your supervisor instructs you to do, you do not have time to complete SESIS-related work, you should email your supervisor and request a written response.
What specifically should I say in that email?
Your email should respectfully say that based on the instructions you were given, you don’t see how you can complete both SESIS and your other work-related obligations during the workday. Ask your supervisor what tasks he or she can remove from your workload, or you can suggest removing duplicative tasks or other ways to free up time in your day. If you wish, you can ask your supervisor for permission in writing to work on SESIS outside the workday with the understanding that you will be paid. The supervisor should specify in writing that you will be compensated.
What if, after all that, my supervisor still orders me to do the work, even if it means completing it after work hours?
As always, if you are given a directive from your supervisor, you should obey that directive and contact the union as to what you should do next.
